Filing A Lawsuit in Georgia (Country)
April 1, 2024As you may have heard, the Law of Georgia on Personal Data Protection was adopted on June 14th, 2023. It aims to provide the standard of protection envisaged by the General Data Protection Regulation (GDPR). Furthermore, the new law makes reporting unlawful data processing in Georgia very simple.
March 1st, 2024 was a notable date for this field of law and data subjects as a significant part of this law came into effect. This should, among others, mean an end to processing data for direct marketing purposes (for example, text messages from companies). But you may have noticed that some companies still send marketing messages without your consent.
What can you do to avoid getting spammed?
Fortunately, you can refer to the Person Data Protection Service and report unlawful data processing. This article guides you through the steps that you need to take to report.
How Do You Report?
You need to take only three steps for this.
1. Register at the case management portal of the Person Data Protection Service.
To register, you need to fill out this brief registration form. You need to indicate information such as email address; first and last name; personal number; place of residence; and phone number.
2. Download the application form and fill it out.
There are three main parts to the application.
- Information About The Applicant And Its Representative (full name; personal number; contact information such as address, phone number, and email address).
- Information About The Breaching Party (full name and contact information such as address, phone number, and email address).
- Factual Circumstances And Evidence (the date of the violations; description of the circumstances surrounding the violation; photos, letters, notes, and evidence in any other form.
3. Submit the filled-out application form in the case management portal and follow the status.
Simply upload the application form and submit it.
Is There An Alternative Way Of Reporting?
If you do not wish to register and use the case management portal, you can simply email the filled-out form together with the attached documents and your identification documents to office@pdps.ge
What Is Next?
The Person Data Protection Service will review the application within 10 days of its submission. They will then issue a decision regarding the possible violation within 2 months. In complex cases, they can extend this deadline further, for 1 month.
Why Is Reporting Beneficial?
If the Person Data Protection Service issues a decision establishing a violation, it is likely that they will also fine the data processor. This should also motivate them to cease processing your (and others’) data unlawfully.
You can also use this decision to file a lawsuit against the data processor. While the decision of the Person Data Protection Service is not binding on the court, it is significantly persuasive authority for the court.
